Recently, the business has been struggling, as a result of online competition, and has decided to make some employees redundant. There is evidence of less business coming in during the previous year. Giles, the HR director, creates a ‘selection pool’ of 15 employees, and has meetings with all of them, individually, notifying them of possible redundancy. A week after that, he chooses 4 employees, for the following reasons:-

Keith, who has been at the company for 5 years, was chosen because Giles had never liked him.

Zara, who had been at the company for 15 years, was chosen because she was close to retirement age.

You are told that the employees are seeking legal advice about whether they could sue the company for unfair dismissal. You are asked to advise Giles, in relation to:-

(c) Keith, and

(d) Zara,

whether a case of unfair dismissal could be brought, the chances of success for any possible actions, and, if successful, what remedies they may be entitled to.
