CityFlats Ltd is a company of estate agents in London, with 10 offices around the capital, and a total of 60 staff members. They specialise in selling high end apartments for young professionals. Recently, the business has been struggling, as a result of online competition, and has decided to make some employees redundant. There is evidence of less business coming in during the previous year. Giles, the HR director, creates a ‘selection pool’ of 15 employees, and has meetings with all of them, individually, notifying them of possible redundancy. A week after that, he chooses 4 employees, for the following reasons:-

Keith, who has been at the company for 5 years, was chosen because Giles had never liked him.

You are told that the employees are seeking legal advice about whether they could sue the company for unfair dismissal. You are asked to advise Giles, in relation to:-
